Terms and Conditions for Playground Guide

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Playground Guide application and website (the “App”) operated by Codefish AS (“us”, “we”, or “our”).
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.
By accessing or using the App you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.
1. Disclaimer and Limitation of Liability
IMPORTANT NOTICE:
The information provided by this App, including but not limited to playground locations, descriptions, photos, ratings, reviews, and amenity details, is largely user-contributed and for general informational purposes only. It may be subject to inaccuracies, outdated information, or errors.
Always verify playground conditions, safety, and suitability in person before use. We do not guarantee the accuracy, completeness, or reliability of any playground information displayed in the App.
To the maximum extent permitted by applicable law, Codefish AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the App;
- Any conduct or content of any third party on the App;
- Any content obtained from the App, including user-contributed playground information; and
- Unauthorized access, use, or alteration of your transmissions or content.
2. Accounts
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our App.
You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password.
3. Subscriptions and Purchases
Some parts of the App may be billed on a subscription basis (“Subscription(s)”). Subscriptions are managed via Apple App Store or Google Play Store. By purchasing a Subscription, you agree to the terms and conditions of the respective store regarding payment, renewals, and cancellations.
4. Rate Limits and Fair Use
To ensure fair usage and service availability for all users, we may impose rate limits on searches, API requests, and access to certain playground information within the App.
You agree to the following usage restrictions:
- You shall not use automated tools, bots, scrapers, or similar technology to access or collect data from the App.
- You shall not engage in excessive querying or bulk data extraction that may degrade service performance for other users.
- You shall not attempt to circumvent or bypass any rate limiting mechanisms implemented by the App.
- You shall not redistribute, resell, or commercially exploit playground data obtained from the App without prior written consent.
We reserve the right to restrict, throttle, or suspend access for any user who exceeds reasonable usage limits or violates this fair use policy. Rate limits may vary and are subject to change at our sole discretion.
5. Intellectual Property
The App and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Codefish AS and its licensors. The App is protected by copyright, trademark, and other laws of both Norway and foreign countries.
6. Links to Other Web Sites
Our App may contain links to third-party web sites or services that are not owned or controlled by Codefish AS.
Codefish AS has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Codefish AS shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
7. Termination
We may terminate or suspend access to our App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
9. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
